American Biogas Council applauds Senate Finance tax changes, but calls for additional work

WASHINGTON – June 17, 2025 – Last night the Senate Finance Committee released its proposed text for budget reconciliation. The American Biogas Council’s (ABC) Executive Director Patrick Serfass released the following statement in response:
“The ABC appreciates the improvements the Senate Finance Committee’s recently released tax text made over the House’s version, particularly the inclusion of several provisions that correctly recognize the positive impact of the biogas industry to reduce waste and instead use it to produce American energy and soil products.
“We are especially encouraged by the extension of the 45Z Clean Fuel Production Credit through 2031 and the recognition of manure-specific carbon intensity scoring — both critical tools for driving investment in low-carbon fuels. The revival of technology-neutral electricity credits under Sections 45Y and 48E, coupled with a reasonable phase-out timeline beginning in 2033, also sends a strong signal of long-term policy stability to give investors the confidence to engage in new projects. Maintaining flexibility on the transferability of credits is a smart approach to accommodate how business is actually conducted between large and small businesses.
“At the same time, there is more work to be done to recognize the true negative carbon intensity of all projects and types of waste which reduce emissions beyond zero. Carbon negative projects often require greater investment and thus more support.
“In addition, the bill should include language to restore the Section 48 investment tax credit for renewable natural gas as well as the 45V credit for hydrogen production.
“ABC thanks the Senate Finance Committee on the excellent progress made and looks forward to continuing to work with members of the Senate and House to improve it further for American prosperity.”
